MIDLAND – A West Texas deputy was fired and three others were suspended after they took a photo of a provocative waitress holding an assault rifle on the back of their squad car earlier this month.

Midland County Sheriff Gary Painter apologized this week for the actions of his deputies while they were attending a law enforcement class in Cedar Park, just north of Austin.

Deputy Daniel Subia, 30, was fired for handing the county-issued AR-15 to the young woman while she posed on the trunk of the car, according to the Midland Reporter-Telegram.

An off-duty officer from a nearby town noticed the waitress holding the assault rifle and called police.

The other three deputies, ranging in age from 31 to 37, were each suspended for three days without pay for taking the woman’s picture.

None of the Midland County deputies were in uniform during the incident. Each said they had drunk three to five beers.

A fifth deputy, who stayed inside the restaurant and was not involved in the incident, was given a written reprimand.
